· Allotment: Allotment shall be made one first
– come first – serve basis on receipt of the booking money as per application.
· Allotment Transfer: Untill the full payment of the
installments, the buyers shall not have the transfer the allotment to a third
party without the consent of the company.
· Payment: All payment are to be made by
crossed cheque/bank draft/pay order etc. the buyers must strictly adhere to the
schedule of payment to ensure timely completion of the construction work to Maks
Living Ltd. Any delay in payment up to two installments, will make buyer liable
to pay 3% interest per month on the payable amount. If the payment is delayed
beyond three installments, the company shall have the right to cancel the
alloment. In such an event the amount paid by the buyer will be refunded after
deducting the booking money.
· Cancellation
of Booking: The schedule agreed in the agreement for all payment by the
allottee shall be of the essence of the contract. It is the agreed that the
allotte will pay a delay charge of 5% per 30 days on the amount of payment
delayed to the authority. If a payment is delayed beyond 90 days the authority
may exercise its right to cancel the allotment. In the event of cancellation an
amount of 10% only the allotters deposited amount for incidental charge. In the event of cancellation of allotment the
allottee’s as deposited amount (after deduction) will be refunded after selling
of the same plot to a new buyer.
· Company’s Right: The Company reserves
the right to accept or reject application for an allotment of plot. The Company
may make minor changes in the design & specification of the project should
those become necessary.
· Registration Costs: The buyer shall bear all costs
relating to cost of stamps, registration fees and related legal fees etc. The
Company will make necessary arrangements for all such formalities.
· Plot Owner’s Welfare Society: That after handover of the plots for the purpose of
effective and efficient management security and maintenance of the project and
privileges provided there in, the purchaser shall form and constitute a welfare
association in the project area. All plot owners will have to become members of
this society and each member will have to deposit as initial sum of TK. 50,000
(Fifty thousand) before delivery of the plots to cover the expenses of the
society and its related activities.
